Employees who are subject to verbal, visual or physical conduct based on a protected class may have a claim for illegal harassment.
- Illegal workplace harassment must be based on sex, sexual orientation, race, color, national origin, religion, age, disability, marital status, or any other category protected by law.
- Work-related harassment is generally actionable regardless of the status of the harasser (e.g., manager, co-employee, office visitor, contractor, vendor or client).
- Offsite incidents may also support a claim of harassment.
- It is illegal for an employer to retaliate or take any adverse employment action (e.g., firing, discipline, demotion) against an employee who either complains about harassment or who participates in an investigation of harassment.
